The technical unemployment represents the suspending of employer’s activity on base of 53 article of Labor Code, period when the employees benefit by an indemnity paid from salary fund. The amount of technical unemployment benefit cannot be less than 75% of base salary of the equivalent job.
The calculation of technical unemployment indemnity is depending on the type of work performed.
The office employees receive an allowance calculated as:
– Salary tariff / number of working days in month * 75% * number of days of business interruption
For workers in technical unemployment, the allowance is calculated as follows:
– Salary tariff / (average annual number of working hours / norm) * 75% * number of days of business interruption
What fees are paid for technical unemployment indemnity
The following fees shall be paid for the allowance calculated in accordance with the above:
No employee and employer contributions for unemployment are paid.
For paying the technical unemployment indemnity, the employer shall suspend labor contracts. The legislation does not provide a maximum duration of technical unemployment, but provides the possibility of reducing working hours from 5 to 4 days per week, with a corresponding reduction in salary. This period lasts until the situation that caused the reduction program is cleared, according to Article 52 of the Labor Code.
