A control by LTI inspectors can occur at any time without prior notice. As long as the company is ready with all the documents that they could request, the risk of penalty is minimal. No LTI control in the field of labor relations will take you by surprise if you ensure to have all documents below handy and right.
The documents that may be required by LTI inspectors (Revisal, labor rights, labor contracts, personnel files):
There are a number of contraventions often fined by the LTI inspectors. The fines in this case are set by Government Decision no. 500/2011 and the Labor Code.
a. The failure in register the employees with complete elements of the labor contract, whether they are employees identifiers, date of employment, position, type, period, normal duration of work and its distribution, salary and increases or detachment period and the employer’s name to whom the detachment is made, the period of suspension the individual labor contract and the causes, labor contract termination date.
In this case, the fine for each person that works without submitting to the Labor Inspectorate of the registry is 10000 lei for each person received to work in these conditions. The fines will not exceed the total cumulative of 50000 lei.
b. The failure to provide the labor inspector the electronic register and / or the employee’s personnel file. The fine may be between 5000 and 8000 lei.
c. The territorial labor inspectorate was not informed of the service providers for companies that have outsourced Revisal registration service – a fine of 2000 to 5000 lei.
d. The failure to register within the time stipulated by law – a fine of 5000 to 8000 lei.
e. If the employer has not complied with the law on granting weekends, the fine is between 1500 and 3000 lei.
f. The failure to comply with legal provisions on night work is amended with amounts between 1500 and 3000 lei.
In practice, the inspectors can complete LTI work control differently in similar situations.
