As a legal act of the employer, the internal regulation is developed in consultation with trade union or employees representatives and establishes a set of rules, primarily disciplinary and professional, applicable at work.
The violation of any of the provisions of the internal regulation consists in the employee disciplinary appeal. The provisions laid down in the internal regulation can legitimize the decision to sanction an employee. The adopted internal rules must be communicated to the employee by the employer and, upon notification, begins to take effect in accordance with Article 243 of the Labor Code.
The legality of provisions of internal rules is checked by the courts, seized by the employee. The internal regulation is posted at the employer headquarters.
