A labor contract is defined as the contract under an individual named employee undertakes to perform work for and under the authority of an employer, person or entity, in exchange of a remuneration referred salary.
A labor contract may be concluded for a definite term or an indefinite one. The minimum age at which an individual can become employed, thus concluding a labor contract, is 16 years. At 15, a person can become employed only with the consent of parents or legal guardians for activities suited to the physical, skills and knowledge, according to the Labor Code.
A labor contract is concluded on the basis of the parties’ consent, in writing, in Romanian. The employer has the obligation to conclude a labor contract in writing. The written form is required for the valid conclusion of the contract.
